These Terms and Conditions ("Terms") govern your access to and use of the EWF Nexus platform, websites, and related services (collectively, the "Services") provided by Elite Window Factory ("Company," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, you must not use the Services.

The Services are intended for authorized business users involved in sales, lead management, estimations, operations, and related activities for window and facade products. You agree to use the Services only for lawful purposes and in accordance with these Terms and any policies communicated to you.

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, where reasonably necessary for maintenance, security, compliance, or business operations.

• You must not attempt to gain unauthorized access to systems, accounts, or data.
• You must not interfere with or disrupt the integrity or performance of the Services.
• You must not upload malicious code or use the Services to transmit unlawful, infringing, or harmful content.
• You must not misuse customer, lead, or financial data obtained through the platform.

You are responsible for the accuracy of information you enter into the Services and for activities conducted under your account. You must keep login credentials confidential and notify us promptly of any suspected compromise.

You agree to comply with applicable laws, industry standards, and internal company policies when handling customer data, quotations, estimations, and payment-related information.

The Services, including software, design, branding, documentation, and content provided by Elite Window Factory, are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from the Services or our proprietary materials.

You retain ownership of business data you submit, subject to our rights to use such data to operate, secure, and improve the Services as described in our Privacy Policy.

Where the Services support recording or tracking of customer payments, deposits, or commercial terms, such features are provided for business administration and do not themselves constitute a payment gateway unless explicitly stated.

Fees, invoicing, refunds, and commercial terms between the Company and its customers or partners are governed by separate agreements, purchase orders, or quotations. Unless otherwise agreed in writing, all payments are non-refundable except where required by applicable law.

To the fullest extent permitted by law, Elite Window Factory and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities arising from or related to your use of the Services.

Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amounts paid by you to us for the Services in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (USD $100), except where liability cannot be limited under applicable law.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

We may suspend or terminate your access to the Services immediately if you violate these Terms, pose a security risk, or if required by law. You may request deactivation of your account through your administrator or by contacting us.

Upon termination, your right to use the Services ceases. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, and governing law—will remain in effect.

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Material changes may be communicated through the Services, by email, or by other reasonable means.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
